The NBA legend Testifies He Felt No Fear of Nascar in Legal Battle

The basketball icon, as he cordially introduced himself in a Charlotte court on Friday, stated that his competitive side and status as a newcomer emboldened his effort with 23XI Racing to confront Nascar over alleged violations of antitrust rules.

Team Investment and a Competitive Drive

The owner disclosed operational insights of his racing venture, revealing he invested $40m of his own funds into the Nascar Cup series team co-founded with partner Polk and driver Hamlin.

“Someone had to step forward,” Jordan stated in the Charlotte courtroom. “As a newcomer, I wasn’t afraid. I felt I could challenge Nascar as a whole. I felt as far as the sport required examination through a new lens.”

Central Issue: Charter Agreements and Renewal Demands

The heart of the case involves the expiration of a 2016 agreement where Nascar granted each team a “charter”. This system mirrors other professional sports with separately owned franchises, like the Charlotte Hornets or the NFL’s Panthers. This deal was due to end in 2024 when Nascar demanded charter membership renewals.

Jordan was on the witness stand for an hour and exited the courthouse to pandemonium, with fans and media clamoring for a view or a picture of the global icon.

Leading the Legal Charge

23XI Racing is leading the full-court press along with Front Row Motorsports for Nascar to overhaul a business model Jordan said is unlawful to keep two hands on the wheel.

For Jordan and and Heather Gibbs, who preceded Jordan, are details from September 2024. She recounted a frantic and emotional six hours where the racing circuit informed teams they must sign a charter agreement extension. The document spanned 112 pages detailing team compensation and a guaranteed spot in every race.

Choosing Litigation

Jordan said that 23XI and Front Row Motorsports decided their sole viable path was to refuse a signature that 112-page package and litigate the matter. All other teams agreed to the terms.

The team owners reached out to Nascar about potential amendments or negotiations. Nascar refused to engage, Jordan said.

The Bottom Line: Winning

But in the end, the resistance against what he saw as a financially unsustainable model was mostly about the usual bottom line for Jordan: Winning.

“Denny convinced me adding a third car improved our chances to win,” he said, noting that he purchased another franchise last year for $28m amid the legal dispute. “So I dove in.”

Gibbs described her request for permanent charters, which she said a written letter to Nascar. She testified the pressure of the contract signing demand was problematic.

According to her, the team founder first tried to call and talk Nascar out of forcing signatures, but CEO Jim France refused the appeal.

“Don’t do this to us,” Gibbs recounted was the message to Nascar’s executives. She said France replied, “Whether I have 20 charters, that’s what I have. If there are 30, I have 30.”
